The Ministry of the Presidency ensures that examine the case of journalist Gilberto Lopes, to respond to inquiries from the Weekly.

El Ministerio de la Presidencia asegura que estudiar el caso del periodista Gilberto Lopes, para responder a las consultas de este Semanario.

Son muchas las personas que debido a su pensamiento crtico y pluma disidente han sospechado lo que el periodista Gilberto Lopes logr comprobar: la Direccin de Inteligencia y Seguridad (DIS) tiene un expediente con su nombre.

Lopes, de origen brasileo, tiene 30 aos de vivir en Costa Rica, donde ha trabajado como periodista de este Semanario y colaborador de diversos medios de comunicacin extranjeros, por lo que decidi el ao anterior optar por la nacionalidad costarricense.
Sin embargo, al realizar los trmites ante la Seccin de Opciones y Naturalizaciones del Registro Civil, la solicitud fue rechazada porque la DIS inform que esta persona aparece registrada en sus archivos.

As qued consignado en el oficio COP-110-2008 del 11 de junio del 2008, donde el entonces subdirector de la DIS, Roberto Guilln, responde a Ricardo Chavarra Barquero, jefe de Opciones y Naturalizaciones del Registro Civil.

El abogado del periodista, Arturo Fournier, asegur que esta consulta del Registro Civil a la DIS es improcedente e ilegal, ya que lo que se establece en la ley para el caso de las naturalizaciones, es que la persona interesada demuestre que no ha sido condenado por delito alguno en Costa Rica, para lo cual presenta su hoja de delincuencia.

Esto fue un atropello a los derechos humanos de Gilberto. El Registro Civil, como consta en los documentos, interpret que aparecer en los registros de la DIS es seal de mala conducta y as lo expres, explic el abogado.

Tras apelar al Tribunal Supremo de Elecciones, este solicit a la DIS informar sobre el contenido de los archivos de Lopes, a lo cual se neg argumentando que se trata de secreto de Estado.

SIN SORPRESA

Al no haber denuncias contra Lopes, el TSE orden que se le otorgara la nacionalidad costarricense, quien a pesar de la satisfaccin de haber completado exitosamente su trmite, qued con el sinsabor de haber confirmado sus sospechas.

A m no me sorprende, se sabe que la DIS la usan para buscar disidentes, gente que discrepa con las polticas de gobierno y yo me manifest abiertamente contra el Tratado de Libre Comercio, por lo que no me sorprende que la DIS tomara nota, aunque no s si esa es su funcin, coment.

Consider inconveniente que otros rganos del Estado se tomen atribuciones que la ley no les otorga, como lo hizo la Seccin de Naturalizaciones al consultar a la DIS, para luego rechazar el trmite, a pesar de cumplir con todos los requisitos.

Para Lopes, es grave que exista una entidad como la DIS que no tiene lmites ni controles en su accionar, y que adems responde a los intereses particulares de una administracin, al estar bajo la tutela del Ministro de la Presidencia.

Resulta que tenemos en el gobierno una persona que ha tenido uno de los honores ms grandes que puede recibir un ser humano, pero se da el lujo de manosear la Constitucin en beneficio propio. Si esa persona se permite eso, dnde deben detenerse los dems?, cuestion Lopes.

QUE CIERREN LA DIS

El caso del periodista Gilberto Lopes gener diversas reacciones en sectores polticos, autoridades y periodistas, que coincidieron en la inconveniencia de mantener una unidad de investigacin como la DIS, que opera como una polica poltica.

El diputado del Frente Amplio, Jos Merino, indic que este tipo de denuncia confirma lo que l mismo como diputado ha sufrido como objeto de investigacin y persecucin por parte de la DIS

Como en este caso y en el mo, no dudo de que en el archivo de la DIS habr ms expedientes sobre todas las personas comprometidas con la lucha popular y la defensa de los derechos humanos, lo cual es muy lamentable, asegur Merino.

Agreg que tiene listo un proyecto de ley para disolver esa polica poltica y obligar a hacer pblicos los archivos que esta unidad ha creado sobre personas que militan en organizaciones civiles o han sido investigados por otros motivos, en clara violacin a sus derechos humanos.

El jefe de fraccin del Movimiento Libertario, Luis Barrantes, coincidi con Merino en la necesidad de cerrar la DIS y asegur que an est a la espera de un informe prometido por el Ministro de la Presidencia, Rodrigo Arias, sobre las actividades de la DIS.

El gobierno no ha actuado respecto de la DIS. Creo que tener un rgano poltico investigativo es muy peligroso, y si est adscrito al Ministerio de la Presidencia, es ms peligroso todava, manifest Barrantes.

El jefe de fraccin del Partido Accin Ciudadana, Francisco Molina, lament lo ocurrido en el caso de Gilberto Lopes y asegur que todo ciudadano tiene derecho a conocer por qu motivo es investigado.

No puede ser que a una persona se le deniegue o se le intente denegar un trmite diciendo que aparece en un archivo, sin dar la informacin porque es secreto de Estado; ya lo hemos dicho, lo mejor que le puede pasar al pas es que se cierre la DIS porque no s a qu estn jugando, ellos deciden quin es bueno y quien es malo, afirm Molina.
El jefe de fraccin del Partido Liberacin Nacional, Oscar Nez, reconoci que se actu en contra de los derechos del periodista Lopes, pero asegur que no se puede cuestionar una poltica de Estado en materia de seguridad por un caso particular.

La poltica en materia de seguridad de Estado no concierne a una persona en particular, es una poltica que debe ir sobre otros temas de seguridad que tambin se investigan en el pas, y si aqu hay delitos de narcotraficantes, de gente que ha incursionado en armas y se les sigue la pista, pues por supuesto que vale la pena tener una unidad de inteligencia, expres Nez.

El Fiscal General, Francisco Dall Anese, reiter su criterio de que la DIS debe cerrarse, pues el pas no puede tolerar un tipo de polica como esta, en la que no existe control.
Es inconstitucional que la DIS declare la informacin secreto de Estado, cuando para eso existe un procedimiento definido por la Constitucin Poltica; y no por decisin arbitraria de una unidad como esta.

No puede ser que aqu se investigue a un periodista porque es de izquierda o porque es de derecha, eso es muy peligroso para el pas y no tiene fundamento jurdico, manifest el fiscal.

PELIGRO PARA EL PERIODISMO

El presidente de la Asociacin de Prensa Extranjera en Costa Rica (APEX) , George Rodrguez, indic que este tipo de investigaciones como las sufridas por Gilberto Lopes, son incmodas para el ejercicio de la prensa extranjera en el pas.

Es preocupante que haya un control del cual el periodista no tenga conocimiento, que pueda generar algn tipo de inseguridad al no saber si se considera bien o mal el trabajo que un corresponsal internacional desarrolla, consider Rodrguez.

El periodista Eduardo Ulibarri, integrante del Instituto de Prensa y Libertad de Expresin (IPLEX), dijo que el caso es preocupante desde el punto de vista de los derechos civiles de cualquier persona, independientemente de su profesin.

Esto tiene un tufo poltico que es inconveniente cuando se trata de los derechos ciudadanos. El periodista trabaja con smbolos y con versiones y su actividad pblica tiene que ver con la libertad de expresin, por lo que me preocupa una investigacin de este tipo, coment Ulibarri.

El presidente del Colegio de Periodistas, Ral Silesky, asegur que la actuacin de la DIS es antidemocrtica y que el pas debe velar por el derecho de todas las personas por tener acceso a su informacin personal guardada en las instituciones pblicas.

Me parece indignante que tengamos archivos registrados donde se estigmatice a personas por su forma de pensar y que esto sea instrumento para decidir a quin se le otorga una nacionalidad. Esto recuerda a las dictaduras y sienta un psimo precedente, concluy Silesky.

UNIVERSIDAD intent conocer el criterio del Ministro de la Presidencia, Rodrigo Arias, y del director de la DIS, Jos Torres; Pablo Guern, encargado de prensa de su oficina asegur que el caso ser estudiado para dar una respuesta a nuestras consultas.
